These Terms of Service ("Terms") govern your access to and use of Metalytics and related services provided by Blu Software ("Blu Software," "we," "us," or "our"). By downloading, accessing, or using the Services, you agree to these Terms.
1. Informational Use Only; No Professional Advice
The Services are provided for general informational and organizational purposes only. Nothing in the Services constitutes financial, investment, legal, tax, accounting, fiduciary, or other professional advice. Market data may be delayed, incomplete, or inaccurate.
2. User Responsibility
You are solely responsible for your portfolio decisions, trading actions, risk management, compliance obligations, and any outcomes resulting from your use of the Services. You should independently verify all information before acting.
3. No Warranty
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or uninterrupted operation.
4. Limitation of Liability
To the fullest extent permitted by law, Blu Software and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenues, lost data, business interruption, security incidents, market losses, or trading losses arising from or related to the Services, even if advised of the possibility of such damages.
5. Data and Security Risk Allocation
You acknowledge that no platform can guarantee absolute security. You are responsible for securing your devices, backups, credentials, and operating environment. Blu Software disclaims liability for unauthorized access, malware, device compromise, third-party platform faults, connectivity failures, or force majeure events.
6. Acceptable Use
You agree not to misuse the Services, reverse engineer the app except where legally permitted, interfere with platform operations, violate applicable law, or infringe rights of Blu Software or third parties.
7. Intellectual Property
The Services, including code, branding, text, graphics, and design elements, are owned by Blu Software or its licensors and protected by intellectual property law. Except for limited personal use, no rights are granted without prior written permission.
8. Third-Party Content and Links
The Services may reference or rely on third-party sources and platforms. Blu Software does not control and is not responsible for third-party content, policies, availability, or performance.
9. Service Changes and Termination
We may modify, suspend, discontinue, or restrict any part of the Services at any time without liability, including for maintenance, security, legal compliance, or business reasons.
10. Indemnification
You agree to defend, indemnify, and hold harmless Blu Software and its affiliates from claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of applicable law or third-party rights.
11. Governing Law and Disputes
These Terms are governed by applicable law in the jurisdiction selected by Blu Software, excluding conflict-of-law rules, unless otherwise required by consumer protection law. Venue for disputes will lie in courts of competent jurisdiction selected by Blu Software where legally permissible.
12. Changes to Terms
We may revise these Terms at any time. The "Last updated" date identifies the current version. Continued use after updates become effective constitutes your acceptance of the revised Terms.
13. Apple Platform Notice
If you access Metalytics via Apple platforms, you acknowledge these Terms are between you and Blu Software only, not Apple. Apple has no obligation to furnish maintenance or support for the Services.
